yup, and also big name djs would be far more likely to have actual permission from the copyright holder to allow them to upload the mix.

i've only had a problem uploading one of my mixes and it was because of the first track as well. it was a song from the 2001 space odyssey soundtrack. this is the one:

you can't blame soundcloud for this. they have to follow the wishes of the copyright holders or they will face serious consequences. it's just what happens when sites like this start to get a lot of momentum.

How do you know that they are not having issues?

I believe it's cos they only scan the first X number of seconds/minutes, as other people have said. I've only had 3 mixes blocked at the point of upload and they were all blocked because of the very first track, which does seem to back that theory up.

I agree with everything you said though. It's the labels that are to blame, because I'm sure SoundCloud don't want to drive people to other sites by taking their mixes/tracks down. I have a Pro Plus account because I've tried a few different hosting services and SoundCloud is the one where I get the most listens by far - it's not even close. That's the main reason why people stick with it.

Soundcloud realizes you can download mixes.. which is why they dont want to infringe on copyrights... why is why you shouldnt post mixes on soundcloud unless you know that there is potential of it being removed.

aka, the whole point of this thread.

No, they really aren't grey areas at all. Not in any way, shape or form. Uploading another persons track without explicit consent is copyright infringement (if copyright exists).

Regardless of 'personal' opinion (which yours is) and regardless of what is common sense (what we agree on) aaaaaand regardless of anybodys municipal laws (country specific) you are breaking YOUR contract with the company, Soundcloud.

Soundcloud even say that they do not give legal advice on copyright but they clearly state what THEY consider to ok or not ok.

I get that the rules are rules, and I'm not even mad about going over to mixcloud. My question is, when these bigger DJs are putting their mixes on soundcloud, why aren't they having issues? Or are they just wiggling by somehow? Is this a stupid question?

I'm guessing they have a list of labels that don't play nice. Those are the ones that you should get pissed off at. Obviously just sticking a track up there for anyone to download is a douche move (does anyone do that even?) but crying foul when someone gives you free publicity from your track being in a mix (and ID'ed)... even douchier. The entire hobby was built on sharing mixes. I mean, seriously, why stop there? Why not send the police to house parties to arrest people for not paying royalties?

Pretty lame rule which is haphazardly enforced. As stated before, they seem to not even do their due diligence to see who owns the copyright. They're hurting themselves. I cancelled my pro account a while back.

Theres so much hatred and arguing going on in this thread. Stop it.

We need to be positive. If you have a mix soundcloud wont let you put up, just put it up for free download on another site, add a samples portion of the mix to soundcloud, et the download link to the full mix in the more options setting of the soundcloud sample and voila your mix is shared on soundcloud.

Soundcloud realizes you can download mixes.. which is why they dont want to infringe on copyrights... why is why you shouldnt post mixes on soundcloud unless you know that there is potential of it being removed.

Let this be a valuable to lesson to anyone who uses public services that allow you to use their services for free or paid. You are often giving up a lot of control over the content that you post when you use these services. Facebook, instragram, soundcloud, if any of these services were to crash there would be no way to get your content back (unless you kept a local copy). I believe it's important to consider creating your own blog/website and using services and players that allow you to host the content on your site. I recently listened to a podcast where this entrepreneur created "Pressgram" (filtered photo editing with uploading to wordpress) for this reason, he can now own his pictures and not sacrifice control to a company such as soundcloud or instagram. I'm not condemning these services you shouldn't use them but by relying on them 100% can definitely backfire and work against you.

Even Grandtheft (famous canadian producer) recently complained about soundcloud blocking his music, which in most cases are official label released remixes.

I don't believe that message is for copyright infringement - you ususally get a message/email saying why if it's copyrighted - I did at least.

3. It is a gray area because copyright laws and TOS agreements based around copyright laws are in of themselves a gray area.

Don't really care I they tag them as copyrighted the rate in upload mixes it doesn't phase me. I don not use mix cloud because I did not like the layout of it.

Sounds go on Soundcloud, mixes go on Mixcloud. Pretty simple, it happens all the time... I don't know why anyone would risk having their stuff taken down when you already know it's most likely going to happen.

Yeah guys, just take your chances and if you get pinged, so be it .. I actually had a mix rejected last week. I tried re-upping a mix from 3 years ago, a house one. 2 Mixes in 6 years isn't too bad for me, however.

We all know its pathetic. We all know that souncloud became big and popular BECAUSE of djs uploading mixes as well as artists tracks. We all disagree that dj mixes damage the music industry.

BUT, we ALL signed the agreement that stated it is not permitted to upload copyrighted music.
No-one has a leg to stand on on this matter. No grey area, no exceptions.

And yes they may get it wrong as in the example posted a few posts above. This has zero baring on others that break the agreement with souncloud .

Because I pay for the service And this is fist time I've had an issue so if happens again will cancel account.saying a mixed set violates copyright is a gray area especially when dealing with paid tracks. I am not shocked just surprised a set with little to no commercial tracks would be nailed but pop mixes I've posted haven't been

or he can just use Mixcloud. or Mixcrate. theres other options. it sucks... but it is what it is

I know a classical recording engineer who posts mixed/mastered preview versions up on a paid account set to private, just to show clients and see if they're happy with how it sounds and he has had his uploads taken down on several occasions even though it's things he recorded himself - just because the music uses a score that is copyrighted, but his clients have paid for.

Why is this a surprise to anyone?

Why are people surprised when they break the law or the rules of Soundcloud. It is not permitted to upload copyrighted music... period. Doesn't matter if we dislike it, that's the way it is.

Leave a 5 second gap at the beginning of your mixes. Soundcloud only check the first 2-3 seconds for copyright breaches. This should solve your problem.
