[OT] eBay Bids Posted on: 18.06.2011 by Lena Schirado Hey guys,I just wanted to get your general opinion on something. I recently bid on a mixer on eBay that had no reserve and ended up winning it for $31. The next day however, the seller refunded me my money with a note saying that $31 was too low for him and he wanted $125. I was wondering if that's actually allowed? What should I do? I was believeing of not going through the hassle of reporting him but I've decided to contact the seller again and give him a chance to fix it. If he doesn't I'm going to report him just so that future buyers don't fall into the same trap. Having people like that on eBay can really take away from the experience of finding a bargain. |

You can file a non-performing seller complaint with Ebay/Paypal after offering the money via Paypal and they don't accept the payment. It's a while since I was last in your position but I remember leaving a seller negative feedback without the transaction really taking place (I attempted payment but they didn't accept it) I don't know if you'll still be able to neg them, in this instance. I filed a seller non-performance complaint but didn't hear anymore about it tbh. Internet acquaintances who've been the bad guy in similar situations say you get a strike against your name each time a complaint is filed, which might lead to their account being closed or suspended so make sure you file a complaint and leave them some negative feedback, if you can, to warn other ebayers and deter the seller from doing it again. Other than that, if the seller isn't happy with the price and refuses the payment there's nothing you can do really, other than threaten him with the above and hope they honour the deal to protect their feedback and seller privileges. |

Marguerite Truka 18.06.2011 | the seller actually agrees to sell the item at the price the auction is settled for like at an auction in person in the UK. So accordming to that he has to sell it. I looked for lawsuits to do with this online auction sort of situation and cant find any. there are lots more complications aswel. but the others are probly right you will never see that item |

Roy Houn 18.06.2011 | as far as im aware, if there was no reserve he has no right to do that, you won it fair and square. I would get on to Ebay and let them know what has happened mate. Its his own fault for not putting a reserve price on his mixer. |

You'll probably won't get the item anyway but at least he'll be 'pursued' (not very scary but then you can't play a game and decide afterwards the rules don't please you). |
Pansy Shiveley 18.06.2011 | Well, eBay certainly doesn't allow it, but that's just their regulation. The worst they can do is kill his account, which probably won't bother him - unless he's got a solid reputation built up which he doesn't want to lose. From a legal point of view, I don't believe he's got any obligation at all to sell it to you for $31. Better luck next time. |
